CODE HOME RULE BILL NO. 2-16 May 2016 Session A Bill Entitled: Revision of Residential Sprinkler Incentive AN ACT TO AMEND THE RESIDENTIAL FIRE PROTECTION SPRINKLER SYSTEM TAX CREDIT, ARTICLE XI, CHAPTER 492, OF THE CODE OF PUBLIC LOCAL LAWS OF ALLEGANY COUNTY, MARYLAND (2011 EDITION AS AMENDED), ENTITLED RESIDENTIAL FIRE PROTECTION SPRINKLER SYSTEM TAX CREDIT BE IT ENACTED BY COUNTY COMMISSIONERS OF ALLEGANY COUNTY: SECTION I. WHEREAS, Chapter 9-232 of the Tax Property Article of the Annotated Code of Maryland authorizes a Tax Credit for Residential Fire Protection Sprinkler Systems; and, WHEREAS, the Board of County Commissioners of Allegany County, Maryland, established a Tax Credit for the installation of Residential Fire Protection Sprinkler Systems; and WHEREAS, the Board of County Commissioners wishes to amend the provisions of the Residential Fire Protection Sprinkler System Tax Credit. NOW, THEREFORE, Article XI of Chapter 492 of the Code of Public Local Laws of Allegany County, Maryland (2011 Edition, as amended), is hereby amended to read as follows: SECTION II. Article XI Residential Fire Protection Sprinkler System Tax Credit 492-31. Tax Credit Eligibility. A. Subject to Rules & Regulations promulgated under this Article, a Tax Credit is available for Owners who have constructed a Residential Property containing a complete Automatic Fire Protection Sprinkler System. B. The Tax Credit granted under this Article shall be in the amount of $1,000 [500] per Tax Year, for a period of three Tax Years, which Tax Credit shall be against the County property tax imposed upon said Residential Property. C. A Tax Credit granted under this Article may be assigned to any subsequent Owner. Bold material is revised language added to the existing law. In order to qualify for the Tax Credit, the Owner must demonstrate to the satisfaction of Allegany County that the Automatic Fire Protection Sprinkler System has been constructed and installed in accordance with accepted codes and standards established by the Maryland State Fire Prevention Commission. 492.32. Termination and Expiration. A. The Tax Credit granted to an Owner shall be for a period of three Tax Years, beginning with the first Tax Year following the installation of the Automatic Fire Protection Sprinkler System. B. Expiration. (1) This Tax Credit program will expire after June 30, 2020 [June 30, 2016]. [, or at such time as Allegany County mandates the installation of Automatic Fire Protection Sprinkler Systems in Residential Property, whichever should first occur. No new Tax Credits will be granted after that time.] (2) An Owner receiving a Tax Credit at the time of the expiration of the Tax Credit program shall continue to receive the Tax Credit for the balance of the three Tax Years of the Tax Credit. SECTION III. All other provisions of the Code of Public Local Laws of Allegany County, Maryland (2011 Edition, as amended), ordinances, regulations, and orders, or parts thereof, inconsistent with the terms and provisions of this Bill, are hereby repealed. SECTION IV. AND BE IT FURTHER ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF ALLEGANY COUNTY, MARYLAND, that this Act shall become effective July 1, 2016.
