CASE NO C-16-44171-G IN THE CIRCUIT COURT FOR ALLEGANY COUNTY, MARYLAND STATE OF MARYLAND ALLEGANY COUNTY COMMISSIONERS, Plaintiff Vs. US CURRENCY IN THE AMOUNT OF NINE THOUSAND EIGHT HUNDRED THIRTEEN DOLLARS ($9,813.00), Defendant Serve On: Marco Alexander Ortega 23328 Whitetail Road Smithsburg, Maryland 21783 PUBLICATION NOTICE Pursuant to Md Code, Criminal Procedure Article, Section 12-310, the State of Maryland, Allegany County Commissioners has filed a complaint seeking forfeiture of the following personal property: PROPERTY: United States currency in the amount of nine thousand eight hundred and thirteen dollars ($9,813), 1. On 4/26/16 I,S/Tpr. Kyle was contacted by Sgt. Farrell who requested that she respond to the MSP Cumberland Barrack located in Allegany County to assist with a drug arrest made by a Trooper. At that time she did respond to the MSP Cumberland barrack where she made contact with S/Tpr. Schoenadel. S/Tpr. Shoenadel stated that he had made a routine traffic stop in the area of W/I-68 at Rocky Gap in Allegany County, MD. S/Tpr. Schoenadel stated the developed probable cause to search the vehicle during the traffic stop. A search of the vehicle revealed the following: Several containers of suspected marijuana in varying weights. Found at the feet of passenger Marco A. Ortega. Also found was $9,813.00 U.S. Currency in a shoe box in the back seat of the vehicle. Ortega stated to S/Tpr. Schoenadel that the marijuana and money belonged to him. Mr. Ortega also had an LG cellular phone with a black case that he stated belonged to him. As a result of this information, Ortega was arrested and charged with possession with intent to distribute marijuana and possession of marijuana. Kyle made contact with Mr. Ortega and did read him his Miranda rights. Mr. Ortega immediately asked to speak to his attorney and was therefore not asked any other questions. The aforementioned $9,813.00 was broken down into ten bundles ;which were each separated by being wrapped with a rubber band. There was also 420.00 (One ten dollar bill and two five dollar bills) loose in the box. Bundle one contained $1,000.00 Bundle two contained $1,000.00 Bundle three contained $733.00 Bundle four contained $1,000.00 Bundle five contained $1,000.00 Bundle six contained $1,000.00 Bundle seven contained $1,000.00 Bundle eight contained $1,000.00 Bundle nine contained $1,280.00 Bundle ten contained $980.00 And the aforementioned loose money in the box was $20.00. Total currency ($9,813.00) in the following denominations: Three (3) One Hundred Dollar Bills $300.00 Thirteen (13) Fifty Dollar Bills $650.00 Three Hundred Seventy Four (374) Twenty dollar bills $7,480.00 Seventy (70) ten dollar bills $700.00 One Hundred Twenty Six (125) five dollar bills $630.00 Fifty Three (53) One dollar bills $53.00 The aforementioned currency and cellular phone were both seized by Kyle. The currency was seized as it was suspected to be the proceeds from sales of CDS including but not limited to marijuana. The LG cellular phone model LS991 bearing serial number 601KPKN0717805 was seized for evidentiary purposes. Tfc Kyle has learned through her training knowledge and experience as a Maryland State Trooper for the past fourteen years, the past ten of which have been spent as a narcotics investigator that those involved in the illicit sales of CDS do use their cellular phone to facilitate sales and to contact their supplier as well as keep records, photos and other digital data pertaining to their criminal contents. Mr. Ortega was presented with property disposition records for the aforementioned currency and cell phone. Mr. Ortega signed both and was given a copy of each. All events did occur in Allegany County, MD. 2. Forfeiture of the property is sought because the property was used in connection with a violation of MD Code, Criminal Law Article, Sections 5-602 through 5-609 and Sections 5-612 through 5-614, 5-618, and are said to be the proceeds of the sale of controlled dangerous substances. The latest date on which a response may be filed is 30 days from the date of the first publication of this notice, which was August 26, 2016. The property shall be forfeited if a response is not filed on time. The response should be filed with the clerk, Circuit Court for Allegany County, Maryland, 30 Washington Street, Cumberland, Maryland 21502.
