Walsh Robb & Walsh, LLC 18 North Centre Street Cumberland, Maryland 21502 (301) 722-5511 Substitute Trustee's Sale of Valuable Real Property Located at 563 Winifred Road Cumberland, MD 21502 Allegany County, Maryland By virtue of the power of sale contained in the Deed of Trust from Larry Anderson dated May 30, 2014 and recorded among the Allegany County Land Records in Book 2059, page 442, default in compliance with the covenants of said Deed of Trust having occurred, the debt secured having come due and payable and demand for payment having been made and refused, James E. Walsh, Substitute Trustee, will offer at public auction at the front steps of the courthouse for the Circuit Court for Allegany County, 30 Washington Street, Cumberland, Maryland on Tuesday, October 11, 2016 at 10:00 a. m.: All that real estate located on Winifred Road comprising two lots and being improved by a dwelling bearing a street address of 563 Winifred Road, Cumberland, Maryland, and more particularly described in said Deed of Trust. Subject to all covenants, restrictions and easements of record, if any. Terms of Sale: A deposit of $5,000.00 will be required on the day of sale in cash or by certified check or other form of payment acceptable to the Substitute Trustee in his sole discretion; the balance to be paid at settlement, except that no deposit shall be required of the party secured under the Deed of Trust and if the secured party buys the property, the payment of the purchase price shall be made by crediting it against the foreclosure costs, expenses and indebtedness secured by the Deed of Trust. Interest shall accrue on the unpaid balance of the purchase price at the rate established by the secured note from the date of sale to the date of settlement. If the purchaser fails to make settlement within ten days following ratification by the Circuit Court, time being of the essence thereto, the property may be resold at the purchaser's risk and cost, and forfeiture of deposit, at the election of the Substitute Trustee, who specifically reserves all legal and equitable remedies. There shall be no abatement of interest allowed for any reason. In the event of a resale, the defaulting purchaser shall not receive any benefit, profit or proceeds therefrom. The sale is "as is" and the Substitute Trustee makes no warranty of any kind whatsoever including, without limitation, the property's physical condition, environmental condition, location, legal description or title. If the Substitute Trustee fails or is unable to convey the property in accordance with the terms of this advertisement, the purchaser's sole remedy shall be return of the deposit without interest. Taxes and other public assessments shall be prorated on and as of the date of sale and shall be assumed thereafter by the purchaser. Following the date of sale, all the risk of loss to the property shall be assumed by the purchaser. The purchaser shall pay all recordation and transfer taxes, document preparation and other costs of settlement. Purchaser shall not be entitled to physical possession of the property before settlement and the Substitute Trustee assumes no responsibility to place the purchaser in possession of the property after settlement. The Substitute Trustee reserves the right to reject any and all bids. The Substitute Trustee reserves the right to vary, modify, alter or qualify any of the foregoing terms or conditions at sale.
